Council invites you to have your say on the draft: Governance Rules.

The Local Government Act 2020 (Vic) was recently passed and has provided Council’s with a range of documents that require either review or creation in phases as prescribed by the Act. The first phase requires implementation of the Governance Rules which must include reference to Council’s Meeting Procedures, Election Period Policy and the internal processes for managing the disclosures of conflict of interests.

Section 60 of the Local Government Act 2020 (the Act) requires Council to adopt and apply Governance Rules which describe the way it will conduct Council meetings and make decisions.

The Governance Rules are a new set of Rules under the Act that will ultimately supersede Council’s Governance Local Law. The required content has previously been adopted by Council however, the Rules will take on a new format and will create some slight changes to the existing Local Law. In accordance with section 60 of the 2020 Act, Governance Rules must include:

a) The expected conduct of Council and Delegated Committee Meetings;

b) The form and availability of meeting records;

c) The election of Council’s Mayor and Deputy Mayor, and procedures for the appointment of an Acting Mayor;

d) An Election Period Policy; and

e) Procedures for the disclosures of conflicts of interests by Councillor of Delegated Committee Members.

Governance Rules Submission Form

Section 60 of the Local Government Act 2020 requires each council to adopt and apply governance rules that describe the way they will conduct council meetings and make decisions by 1 September 2020. Council must make available for inspection a copy of any submissions made. Council may also provide copies of submissions to other parties for the purpose of consideration as part of the planning process.

Name and contact details of submitters are required for Council to consider submissions and to notify such persons of the opportunity to attend Council meetings and any Panel Hearing held to consider submissions.
